The grievance of the petitioner pertains to nonpayment of gratuity. The petitioner relies on a representation being Annexure P-4 at page 15 of the writ petition, whereby he requested the Cooch Behar Municipality for payment of Gratuity.

Mr. Basu appears on behalf of the Municipality and submits that he has no objection if the respondent no. 2 is directed to consider the representation of the petitioner dated 10.08.2020.

In view of the submissions of the parties, WPA 7113/2020 is disposed of with a direction to the respondent no. 2 to consider the representation of the petitioner dated 10.8.2020 within a period of four weeks from date. The respondent no. 2 is directed to communicate the result of the consideration to the petitioner within a period of two weeks thereafter.

It is made clear that respondent no. 2 will not be influenced on the merits of the case by any observation made in this order.

With the aforesaid directions, WP 7113/2020 is disposed of.

There will be no order as to costs.
