The appellant is not represented, nor any accommodation is prayed for on behalf of the appellant. The order directing the status quo as regards the custody of the child until further order is a subject matter of challenge in this appeal. Having regard to the nature of dispute and the reasons furnished by the learned Trial Judge in directing the status quo as regards the custody of the child does not appear to be arbitrary or not in interest of the child, we are not inclined to interfere with the impugned order.

Accordingly, the appeal stands dismissed.

However, there shall be no order as to costs. The department is directed to communicate this order to the learned Additional District Judge, Second Court at Alipore in MAT Suit No.43 of 2001 for information. (Siddhartha Roy Chowdhury, J.) (Soumen Sen, J.)
