(40) KC C.R.M. 6527 of 2020 (Via Video Conference) In Re:- An application for anticipatory bail under Section 438 of the Code of Criminal Procedure in connection with Dantan Police Station Case No. 199 of 2020 dated 14.08.2020 under Sections 341/323/325/354/506/509/34 of the Indian Penal Code.

Mr. Steven Biswas.............................For the petitioners. Mr. Anwar Hossain, Ms. Ratna Ghosh...........................For the State. The petitioners undertake to affirm and stamp the petition as per the Rules within 48 hours of resumption of normal functioning of the court. The petition is taken up through video conference on the basis of such undertaking. The State produces the case diary and it does not appear that any serious injury has been suffered by any person. However, the State points out that the complainant is an advocate of this court. Considering the nature of the incident and the extent of injuries suffered there does not appear to be any need of the petitioners being taken into custody as long as they cooperate with the investigation and report to the investigating officer as and when called.

In the event of the petitioners being arrested, they will be enlarged on bail upon furnishing security of Rs. 10,000/- (Ten Thousand) each with two sureties of equal amount each, one of whom must be local, to the satisfaction of the arresting officer. The petitioners should also comply with the conditions laid down in Section 438(2) of the Code. CRM 6527 of 2020 is disposed of.
