The petitioner undertakes to affirm and stamp the petition/application as per Rules within 48 hours of resumption of normal functioning of the Court. Subject to such undertaking, the application is taken up for hearing through video conference. Pursuant to the order dated 22nd September, 2020 the Investigating Officer has submitted report wherefrom it prima facie appears that the present petitioner has purchased the vehicle under a sale agreement on 6th May, 2017 from one Nesar Ahammed son of Md. Ishaque of 118 Doctor Sundari Mohan Avenue, Kolkata-700014 and on that aforesaid basis he is in possession of the vehicle in question which is involved in the commission of alleged offence. The petitioner is in custody for over 350 days. In view of the fact that the charge-sheet has already been filed and the trial court has fixed December 5, 2020 for framing of charges we expedite the trial. We direct the trial court to frame the charge on the date fixed without granting any adjournment to either of the parties

and thereafter to take the proceeding to its logical conclusion as expeditiously as possible adhering to a time schedule to be framed by the learned trial judge at the time of framing of the charges.

The report filed by the Investigating Officer is kept with the record.

This application accordingly stands disposed of. There will be no order as to costs.
