(22) KC C.R.M. 6549 of 2020 With CRAN 1 of 2020 (Via Video Conference) In Re:- An application for anticipatory bail under Section 439 of the Code of Criminal Procedure in connection with Englishbazar Police Station Case No. 143 of 2018 dated 19.02.2018 under Sections 395/397/412/307 of the Indian Penal Code, Sections 25,27, 35 of the Arms Act and Sections 3 and 4 of the Explosive Substances Act.

The petitioner undertakes to affirm and stamp the petition as per the Rules within 48 hours of resumption of normal functioning of the court. The petition is taken up through video conference on the basis of such undertaking. The prayer is founded on the delay in the conduct of the trial.

The petitioner has been arrested in connection with a dacoity case. It is understandable that no progress has been made in any criminal trial over the last six months or so. Neither the court nor the prosecution can be blamed for such delay. It is hoped that the trial will be taken up in right earnest immediately upon normal functioning of court resuming.

The prayer is rejected.

CRM 6549 of 2020 along with the interim application therein are disposed of.
