Having heard the learned advocates for the petitioner and the prosecution and on perusal of the case diary, it is ascertained that the offending weapon was recovered on the basis of the statement made jointly by the petitioner and co-accused from the house of the deceased when the petitioner was in custody of the police. Though the petitioner has not been named in the FIR, the complicity is quite apparent from the face of the case record. Considering the extent of complicity, prayer for bail of the petitioner is refused.
