Case No.216 of 2018 dated December 24, 2018 under sections 364A/120B/34 of the Indian Penal Code.

Mr. Malay Bhattacharyya ...for the petitioner. Mr. Ranabir Roy Chowdhury Mr. Mainak Gupta ... for the State. The advocate-on-record for the petitioner undertakes to affirm and properly stamp the petition as per the rules within one month of resumption of normal functioning of the court. The petition is taken up through video-conference on the basis of such undertaking. Accordingly, CRAN No.1 of 2020 is disposed of. The learned advocate appearing for the petitioner submits that the present petitioner is situationally placed on a better footing than other co-accused persons who have been granted bail either by a Co-ordinate Bench or by Hon'ble Apex Court.

The learned advocate appearing for the State is unable to controvert the said submission advanced by the learned advocate for the petitioner.

In view of the aforesaid, we are inclined to release the present petitioner on bail as other accused persons including one Rabiul Islam @ Chottee @ Chottu @ Chattu was granted bail in CRM 6020 of 2020.

Accordingly, the petitioner shall be enlarged on bail subject to the satisfaction of the learned Additional Chief Judicial Magistrate, Barrackpore, North 24 Parganas upon furnishing a bond of Rs.10,000/-(Rs. Ten thousand only) with two sureties of like amount, one of whom shall be local and on condition that the petitioner shall attend on all dates and an unexplained absence will entitle the trial court to cancel the bail without reference to this Court. Accordingly, the application for bail, being CRM No. 6600 of 2020 is disposed of.
