Petitioner undertakes to affirm and stamp the petition/application as per Rules within a month of resumption of normal functioning of the Court. Subject to such undertaking, the application is taken up for hearing through video conferencing.
Learned advocate for the petitioner submits that the petitioner is in custody for about 322 days. The case has been very recently been committed to the court of sessions. According to the learned advocate further detention of the petitioner is unwarranted for the sake of the case. Mr. Mukherjee, learned advocate appearing for the State draws the attention of this Court to the statement
under Section 164 of the Code of Criminal Procedure of the victim.
We have perused the statement of the victim under Section 164 of the Code of Criminal Procedure and other materials which have been collected by the investigating officer. We are of the opinion that the nature and gravity of the offence do not warrant interference of this Court for release of the petitioner on bail. Accordingly, prayer for bail of the petitioner is rejected.
