16.09.2020 Item No.52 Court No.08 Dc/Aj.

C.R.M. 6625 of 2020 C.R.A.N. 1 of 2020 (Through Video Conference) In Re : An Application for anticipatory bail under Section 438 of the Code of Criminal Procedure in connection with Rampurhat P.S. Case No. 195 of 2020 dated 11.06.2020 under Sections 341/324/354/307 of the Indian Penal Code. And In the matter of : Chandan Let. ... Petitioner. Mr. Arnab Saha. ... For the Petitioner. Mr. Goutam Wilson.

... For the State.

Petitioner undertakes to affirm and stamp the petition/application as per Rules within one month of resumption of normal functioning of the Court. Subject to such undertaking, the application is taken up for hearing through video conference.

Learned counsel appearing on behalf of the petitioner submits that out of political rivalry, the present case was instituted falsely against the petitioner. In fact, the petitioner had suffered injury for which the petitioner wanted to lodge FIR, but the same was not registered instead after about 16 days, the present case was lodged against the petitioner. Learned counsel appearing on behalf of the State, in his usual fairness, submits that charge-sheet has been submitted only under bailable charges Section 307 of the Indian Penal Code has not been imputed against the petitioner. Therefore, the application for anticipatory bail is not maintainable any more.

In view of the fact that charge-sheet has been submitted only under bailable provisions, no further order need be passed in this case.

The petitioner shall be at liberty to pray for bail in connection with the bailable offences.

With these observations, C.R.M. 6625 of 2020 and C.R.A.N. 1 of 2020 are disposed of.

Urgent Photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
