Advocate Mr. Mainak Gupta, Ld. Advocate ... for the State The petitioners are the married sister-in-law and her husband of the deceased. They are booked in committing offence under Sections 498A/201/304B/302/34 of the Indian Penal Code. It is not disputed that the petitioners reside separately at their house. They did not reside with the victim during her lifetime.

Considering the materials in the case diary, we are inclined to release the petitioners on anticipatory bail. In the event of arrest, the petitioners may find bail of Rs. 10,000/- (Rupees ten thousand only) with two sureties each of like amount, one of whom shall be a local surety to the satisfaction of the arresting authority subject to the condition contained in Section 438(2) of the Code of Criminal Prcedure with further condition that they will file an affidavit stating their present address before the investigating officer and shall not leave the jurisdiction of the police station without the order of the learned trial court.
