03.11.2020 rrc CRM 6659 of 2020 with IA No. CRAN 1 of 2020 (Via Video Conference) In re : An application for anticipatory bail under Section 438 of the Code of Criminal Procedure in connection with Bagdah P.S. Case No. 501 of 2020 dated 25.08.2020 under Sections 498A/304B/406 of the Indian Penal Code.

In the matter of : Raju Tarafder @ Tarafdar & Ors. ..... petitioners Mr. Arnab Chatterjee ....For the petitioners Mr. Rana Mukherjee, Ld. APP Mr. Goutam Wilson .....For the State The petitioners undertake to affirm and stamp the petition as per the Rules within 48 hours of resumption of normal functioning of the court. The petition is taken up through video conference on the basis of such undertaking.

The petition is not pressed as regards the first petitioner since such petitioner has already been arrested. The other petitioners are the relatives of the first petitioner. the first petitioner is the husband of the deceased victim. The victim committed suicide after six years of marriage. The State produces the statements of the local witnesses claiming that the victim would be tortured upon her failing to get further money from her parents. However, such allegations are general in nature and, in any event, the petitioners 2, 3 and 4 do not appear to have any role in the unnatural death of the victim.

Considering the circumstances, the petitioners 2, 3 and 4 are entitled to anticipatory bail. The petition is dismissed as against the first petitioner (Raju Tarafder @ Tarafdar). In the event of arrest, the petitioner No. 2 (Nowchar Tarafder @ Naosar Tarafdar), No. 3 (Samim Tarafder @ Iliyas Tarafdar) and No. 4 (Sarjina Taradeer @ Sarajina Tarafdar) should be released on furnishing security of Rs.10,000/- (Rupees ten thousand) each with two sureties of like amount each, one of whom must be local, to the satisfaction of the arresting officer. The petitioners 2, 3 and 4 will also comply with the conditions laid down in Section 438(2) of the Code.

CRM 6659 of 2020 and the interim application therein stand disposed of.
