Rajjak Molla v. State Of West Bengal
23.09.2020 Court No.16 Sl. No. 19 GB/SD CRM 6662 of 2020 CRAN 1of 2020 (Via Video Conference) In Re: - An application for bail under Section 439 of the Code of Criminal Procedure in connection with Jibantala P.S. Case No.249 of 2014 dated 03.052014 under Sections 148/149/302/34/120B of the Indian Penal Code and Section 25(1B)(a)/35 of the Arms Act. And In the matter of: Rajjak Molla ....Petitioner.
Mr. Angshuman Chakraborty.
.... for the petitioner.
Mr. Swapan Banerjee, Mr. Arani Bhattacharyya.
...for the State.
The petitioner undertakes to affirm and stamp the petition as per the Rules within one week of resumption of normal functioning of the Court. The petition is taken up through video conference on the basis of such undertaking.
The petitioner claims that others standing on the same footing as the petitioner have been granted bail and the petitioner should be extended the same benefit.
The State says that the offending weapons were recovered from the petitioner's residence at the instance of the petitioner. The State says that there is sufficient material to label the petitioner herein as the principal accused.
Though the petitioner insists that weapons have been discovered from the houses of some of the other persons who have been granted bail, the material against this petitioner appears to be quite overwhelming.
Considering such position, the prayer for bail is refused. CRM 6662 of 2020 and the interim application are disposed of. (Sanjib Banerjee, J.) (Aniruddha Roy, J.)
