The petitioner undertakes to affirm and stamp the petition as per the Rules within 48 hours of resumption of normal functioning of the court. The petition is taken up through video conference on the basis of such undertaking.

The petition has been filed primarily because of the delay of completion of the trial. The petitioner seeks to rely on the deposition of the survivor to suggest that no case has been made out against the petitioner.

The State says that most of the witnesses have already been examined and the matter is virtually at the argument stage. Considering the fact that no criminal trial could take place in the last few months, the prayer for bail is rejected at this stage. CRM 6703 of 2020 and the interim application filed therein are disposed of.
