CRM 6743 of 2020 with IA No: CRAN 1 of 2020 In Re: - An application for bail under Section 439 of the Code of Criminal Procedure in connection with New Town P.S. Case No.510 of 2019 dated 10.12.2019 under Sections 366A/370/370A/372/120B of the Indian Penal Code read with Sections 3/4/5/7 of the Immoral Traffic Prevention Act and Section 17 read with Section 4 of the POCSO Act.

And In the matter of: Abhijit Mondal ....Petitioner Mr. Sabir Ahmed Ms. Sonali Das ... For the Petitioner Mr. S.S. Imam Mr. Subrato Roy ... For the State The petitioner undertakes to affirm and stamp the petition as per the Rules within one week of resumption of normal functioning of the court. The petition is taken up through video conference on the basis of such undertaking.

The petitioner says that when the prayer was last rejected by this Court on June 5, 2020, the petitioner was not in possession of some of the records and could not indicate that the statements given by the survivors or the witnesses did not implicate the petitioner in any manner.

Though the State says that there are several statements of survivors which clearly name the petitioner, such aspect of the matter cannot be gone into at this stage. What must be seen is that the prayer was rejected by this Court on June 5, 2020 and the petitioner

does not cite any subsequent events for the consideration to be altered or the matter to be revisited.

In such light, the present prayer for bail cannot be acceded to. CRM 6743 of 2020 and IA No: CRAN 1 of 2020 filed therein stand disposed of.
