And In the matter of: Parimal Barman ....petitioner Mr. Kalipada Das ... for the petitioner Mr. Arjun Luksom Ms. Namrata Das ... for the State The petitioner undertakes to affirm and appropriately stamp the petition as per the Rules within 48 hours of resumption of normal functioning of the Court. The petition is taken up through video conference on the basis of such undertaking.

The petitioner claims that only five packets of tea bags were recovered from a vehicle said to be in the possession of the petitioner.

The State says that the petitioner fled from the spot and the petitioner could be a habitual offender. According to the State, some stolen items found from the possession of the petitioner indicate the petitioner's involvement. The petitioner claims that the vehicle from which the seizure was made was abandoned; though the State says that

the petitioner was the driver thereof and abandoned the same when he noticed the raiding party.

Considering the material, the custodial interrogation of the petitioner cannot be immediately excused and the petitioner's prayer is declined.

CRM 6742 of 2020 and the interim application therein are disposed of.
