And In the matter of: Selim Sk ....petitioner Mr. Somnath Adhikary ... for the petitioner Mr. Arijit Ganguly Mr. Sanjib Kumar Dan ... for the State The petitioner undertakes to affirm and appropriately stamp the petition as per the Rules within 48 hours of resumption of normal functioning of the Court. The petition is taken up through video conference on the basis of such undertaking.

The petitioner claims that there is no material against the petitioner to proceed against him.

The State produces the memorandum-of-evidence. The report of the Inspector-in-charge reveals that a different case has been subsequently started. So far as the material for the present case is concerned, there does not appear to much against the petitioner.

Considering the material, the petitioner is entitled to anticipatory bail.

Accordingly, in the event of arrest, the petitioner will be released on anticipatory bail upon furnishing security of Rs.10,000/-(Ten Thousand only) with two sureties of like amount each, one of whom must be local, to the satisfaction of the arresting officer.

The petitioner will also comply with the conditions laid down in Section 438(2) of the Code.

CRM 6748 of 2020 and the interim application therein are disposed of.
