Accordingly, the application being CAN 1 of 2020 is disposed of.

The petitioner is aggrieved by an order dated August 28, 2020 passed by the D.I. of Schools (SE), South 24-Parganas. The petitioner has been denied post graduate scale of pay as according to the D.I. of Schools, the notification dated February 2, 2017 has no retrospective effect.

Since no detailed reasons have been mentioned in the said order, it is deemed necessary that the matter be considered by the Secretary, School Education Department after calling for an appropriate report from the D.I. of Schools (SE), South 24 Parganas. The Secretary shall hear out the petitioner and/or his legal

representatives and pass a reasoned order as to why if at all, the writ petitioner should not get the post graduate scale of pay within a period of 4 months from the date of communication of a copy of this order. The reasoned order shall be communicated to the parties within a period of 7 days thereof.

With the aforesaid directions, WPA 7160 of 2020 is disposed of.

All the parties are to act on a server copy of this order on the usual undertaking.
