For the petitioner ,, Mr. Kushal Chatterjee, learned Counsel appearing on behalf of the petitioner submits that since the learned Civil Judge, Junior Division, 2nd Court at Barrackpore has now started its functioning, he is withdrawing his main prayer in this revisional application for transfer of the proceeding. He now submits that a direction may be given upon the learned Court below for expeditious trial of the main suit.

Despite service nobody appears on behalf of the opposite party.

Since it is an innocuous prayer made on behalf of the learned Advocate for the petitioner, this revisional application is disposed of directing the learned Civil Judge, Junior Division, 2nd Court at Barrackpore, North 24-Parganas to hear the Suit expeditiously and complete the trial preferably within a period of one year without

granting any unnecessary adjournment to either of the parties.

With the above direction, this revisional application is disposed of.

As a consequence thereof, the connected application is also disposed of.

Urgent photostat certified copy of this order, applied for, be handed over to the parties on usual undertaking.
