The petitioner undertakes to affirm and stamp the petition as per the Rules within one week of resumption of normal functioning of the court. The petition is taken up through video conference on the basis of such undertaking.

The petitioner is the wife of the deceased. The petitioner says that the relatives of the husband suspect that the wife and her family administered poison to the petitioner's husband. The State says that the husband travelled to the wife's paternal place where the wife had previously gone and it is at such place that poison had been administered to the deceased. The mother of the deceased was called when the deceased fell ill and it is the mother's assertion that when she removed her son from his in-laws' in an ambulance, the son claimed that his wife and her relatives had administered poison. The State also says that an exception has been

taken to the charge-sheet by the victim's mother and such application is pending.

Since the charge-sheet has already been filed, the immediate detention of the petitioner may not be necessary. However, if firmer material is discovered against the petitioner, appropriate steps may be taken.

At the moment, in the event of arrest, the petitioner will be enlarged on bail on furnishing security of Rs.10,000/- (Rupees Ten Thousand only), with two sureties of like amount, one of whom must be local, to the satisfaction of the Arresting Officer. In addition, the petitioner will abide by the conditions in Section 438(2) of the Code of Criminal Procedure, 1973.
