25.09.2020 gd CRM 6806 of 2020 CRAN 1 of 2020 (Via Video Conference) In Re: - An application for bail under Section 439 of the Code of Criminal Procedure in connection with Hili P.S. Case No.41 of 2020 dated 15.03.2020 under Sections 14A(b)/14C of the Foreigners Act. And In the matter of: Koush Barman @ Kush.

....Petitioner.

Mr. Kaushik Choudhury ...for the Petitioner.

Mr. Bidyut Kumar Roy Ms. Rita Datta ...for the State.

The petitioner undertakes to affirm and stamp the petition as per the Rules within one week of resumption of normal functioning of the court. The petition is taken up through video conference on the basis of such undertaking.

The petitioner claims that the petitioner is an Indian national and there is no material to detain him as long as he had been detained.

The State claims that the petitioner had harboured a Bangladeshi national and is in the habit of doing so. Considering the mass infiltration that takes place with the help of the local residents around the border areas in the State, the petitioner should not be enlarged on bail at this stage. CRM 6806 of 2020 along with the interim application therein are disposed of.
