Re : W.P.A. 7184 of 2020 This is an application under Article 226 of the Constitution of India wherein the writ petitioner is aggrieved by unauthorised construction carried on by respondent no.8.

Inspite of service, none appears on behalf of the respondent no.8, the private respondent herein. It is to be noted that Howrah Municipal Corporation is represented in Court.

Counsel on behalf of the Howrah Municipal Corporation submits that the prayer 'b' of the writ petition

may be considered. Thus, the respondent authorities be directed to consider the representation of the writ petitioner dated July 7, 2020 (annexure P4).

I have heard learned Counsel for the appearing parties and am of the view that this writ petition can be disposed of with the following directions :- The respondent no.6 shall consider the representation of the writ petitioner dated July 7, 2020 after granting an opportunity of hearing to the writ petitioner as also the private respondent and pass a reasoned order within a period of six weeks. The Corporation is directed to act in accordance with law after passing of the reasoned order.

With the above observation, this writ petition is disposed of.
