The writ petitioner is aggrieved by the order dated 4th August, 2020 issued by the Indian Council of Medical Research / National Institute of Cholera and Enteric Diseases. The petitioner participated in the process of selection to the post of Lower Division Clerk in terms of notification for employment issued in August, 2019. The petitioner was unsuccessful. The petitioner under the RTI Act requested for the question booklet, the answer key and his answer sheet. He also asked for the marks obtained by him in the online examination held on 26th July, 2019 and the cut-off marks.

It was communicated to the petitioner that he secured 54.75 (60.83%) in the MCQ test. He also secured 21.83 Gross WPM and 21.33 Net WPM.

It was further indicated that the cut-off marks for the written test was 50% for General category and 40% for reserved category. The minimum speed for typing was 35 w.p.m. In these circumstances, this Court does not find any infirmity in the rejection of the petitioner's case.

The non-supply of the answer script, question paper or the answer key is irrelevant and academic in the facts and circumstances of the case.

Hence, the writ petition must fail and is hereby dismissed. In view of dismissal of the writ petition, CAN 1 of 2020 is also disposed of.

There shall be no order as to costs.
