Report reflects that the accused persons namely, Damadar Nasker and Pradip Bag were discharged. However, supplementary charge sheet has been submitted under Sections 420/406/120(B)/506/34 of the Indian Penal Code against Jagadish Chandra Bag.

In view of the supplementary charge sheet being filed and the documents on which the prosecution has relied upon being not available with the petitioner, I am of the view that the accused petitioner, namely Jagadish Chandra Bag may be granted liberty to agitate the points canvassed in the revisional application at the

appropriate stage of the proceedings after obtaining all the documents under Section 207 of the Code of Criminal Procedure. The de facto complainant is present in person. The de facto complainant is granted liberty to agitate his grievance before the jurisdictional Court, if so advised under Section 173(8) of the Code of Criminal Procedure.

Learned advocate for the State is directed to hand over a copy of the report to the de facto complainant who is appearing in person.

With the aforesaid observations, CRR 1340 of 2020 is disposed of.

All pending connected applications, if any, are consequently disposed of.

Interim order, if any, is hereby vacated.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court. ( Tirthankar Ghosh, J.)
