CRM 6845 of 2020 with IA No. CRAN 1 of 2020 (Via Video Conference) In Re: - An application for bail under Section 439 of the Code of Criminal Procedure in connection with Dasnagar P.S. Case No.85 of 2016 dated 14.03.2016 under Section 20(b)(ii) of the Narcotic Drugs and other Psychotropic Substances Act.

And In the matter of: Sandip Bit ....Petitioner Mr. Akash Ray ...for the Petitioner Mr. Narayan Prasad Agarwala Ms. Subhshree Patel ...for the State The petitioner undertakes to affirm and stamp the petition as per the Rules within 48 hours of resumption of normal functioning of the court. The petition is taken up through video conference on the basis of such undertaking.

The petitioner says that it has been inadvertently missed out that the similar prayer was made in May, 2020 and was rejected by this Court.

In view of such position, the present petition is dismissed on the ground that there is no change in circumstances. If there is any change in circumstances, the petitioner will be at liberty to file afresh. CRM 6845 of 2020 and the interim application therein are disposed of.
