13.10.2020.

Item No. 36 W.P.S.T. 73 of 2020 With I.A. No. CAN 1 of 2020 Md. Hasimuddin @ Mohhamod Hasimuddin & Ors.

Vs.

The State of West Bengal and others.

(Through Video Conference) Mr. Surojit Samanta, Mr. Biswajit Samanta.

... for the petitioners.

Mr. Joytosh Majumdar, Ld. G.P., Mr. Pinaki Dhole, Mr. Rajat Dutta.

... for the State.

The petitioners undertake to affirm and stamp the petition as per the Rules within one month of resumption of the normal functioning of the Court. The petition is taken up through video conference on the basis of such undertaking.

Accordingly, the application being IA No. CAN 1 of 2020 is disposed of.

After going through the original application filed before the Administrative Tribunal, we have no hesitation in our mind that the primary relief is of 'promotion' as would be evident from prayer (d) under paragraph 7 of the Original Application, which is as under:

"(d) DIRECTION do issue directing consideration forthwith of the case of EOMEEs/LEOMEEs for grant of promotion to the posts of District Mass Education Extension Officers / Assistant Director, Mass Education Extension/Chief Superintendent, State Welfare Home, Banipur and thereupon granting such promotion w.e.f.

the date they became eligible for such promotion with all consequential benefits along with interest at the rate of 18% per annum on all arrear accumulations."

Accordingly the order impugned is perfect and does not call for any interference.

The writ application is thus dismissed.

However, we direct the Tribunal to hear out the interim application as expeditiously as possible. ab (Soumen Sen, J.) (Saugata Bhattacharyya, J.)
