Mr. Sayan Datta Mr. Dipanjan Datta Mr. Subhojit Chowdhury ... for the petitioner The defendant in a suit for declaration of title is very much anxious for disposal of the Title Suit which, according to him, is being unnecessarily delayed by the plaintiffs.

It appears from the order sheet that the suit was dismissed for default and the same was restored by an order dated January 27, 2019 passed in a Misc. Case under Order 9 Rule 9 of the Civil Procedure Code. The learned advocate appearing on behalf of the petitioner could not apprise this court as to what is the next date fixed in the suit.

In view of the pandemic situation the parties as well as their learned advocates are facing difficulties in attending the court. However, the learned advocate appearing on behalf of the defendant/petitioner has assured this court that the defendant and the learned

advocate representing the defendant will not pray for any accommodation on the ground of any inconvenience before the learned court below.

CO 1221 of 2020 and CAN 1 of 2020 are disposed of by requesting the learned Civil Judge, Junior Division at Raiganj to make all endeavour to dispose of the Title Suit No.137 of 2011 as expeditiously as possible after resumption of the normal functioning of the trial court.
