Subject to such undertaking, the application is taken up for hearing through video conferencing. Accordingly, the application being 1 of 2020 is disposed of. Having considered materials on record and bearing in mind the prima facie involvement of the petitioner in the alleged possession of narcotic substance above commercial quantity and in view of the statutory restrictions under section 37 of the NDPS Act, we are of the opinion that this is not a fit case to grant bail to the petitioner.

Accordingly, the prayer for bail is rejected. However, in view of the protracted period of detention suffered by the petitioner i.e. over two years we request the special court to continue with the trial and concluded the same at an early date.
