Gopal Singh v. State Of West Bengal

2020-09-18Hon'Ble Justice Joymalya Bagchi (27.06.2011 - 29.08.2020),Hon'Ble Justice Suvra Ghosh1 pages

18.09.2020 Item No. 28 Sdas rejected C.R.M. 6886 of 2020 with CRAN 1 of 2020 (via video conferencing) In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Singur Police Station Case No. 221 of 2019 dated 31.07.2019 under Sections 302/34 of the Indian Penal Code.

And In Re : Gopal Singh ..... petitioner Mr. Ramashis Mukherjee ... for the petitioner Mr. Prasun Kumar Datta, learned A.P.P.

Mr. Nirupam Dhali ... for the State Petitioner undertakes to affirm and stamp the petition/application as per Rules within one month of resumption of normal functioning of the court. Subject to such undertaking, the application is taken up for hearing through video conferencing.

Accordingly, application being CRAN 1 of 2020 is disposed of.

Having considered the materials on record prima facie disclosing involvement of the petitioner in assaulting the victim resulting in his death, we are of the opinion that the petitioner does not stand with the same footing with co-accused who has been enlarged on bail and this is not a fit case to grant bail to the petitioner at this stage.

The application for bail is, thus, rejected.
