Subhra Kishor Chakraborty v. Union Of India
28.09.2020 Item No. 45 Ct. No. 24 PG W.P.A. 7274 of 2020 with I.A. No.: C.A.N. 1 of 2020 (Through Video Conference) r Subhra Kishore Chakraborty & Anr.
Vs.
Union of India & Ors.
Mr. Shahan Shah..........for the petitioners Mr. Rajib Mukherjee....for the BSNL C.A.N. 1 of 2020 is an application for urgent hearing of the writ petition and is disposed of by taking up the writ petition for consideration. Petitioners seek an order of eviction against BSNL authorities on the ground of expiry of lease. BSNL authorities are represented.
A tenant is entitled to protection under the tenancy laws. BSNL authorities cannot be denied such protection. In any event, there appears to be disputed questions of facts involved.
In such circumstances, I do not find the present writ petition to be maintainable.
W.P.A. 7274 of 2020 is disposed of accordingly.
This order will not prevent the petitioners from taking appropriate steps for evicting the BSNL
authorities in accordance with law before the appropriate forum.
