In re: CAN 1 of 2020 This is an application for urgent hearing of the writ petition and is disposed of by taking up the writ petition for consideration.
Petitioners complain of police inaction.
Learned Advocate appearing on behalf of the petitioners submits that, in a police complaint regarding an assault to a woman, the police are yet to record a statement under Section 164 of the Cr.P.C. and seize the wearing apparels and the medical documents relating to the victim.
Learned Advocate appearing on behalf of the State submits that, tomorrow is the date fixed for recording the statement of the victim under Section 164 of the Cr.P.C. The police having registered a FIR and the police continuing with the investigation with regard thereto, at this stage, further interference is not called for, save and except, in the manner as provided herein. The police authorities will seize the medical documents and the wearing apparels of the victim, if not already seized. The police will facilitate the making of the statement under Section 164 Cr.P.C. by the victim.
W.P.A. 7276 of 2020 is disposed of without any order as cots.
Affidavit of service filed on behalf of the petitioner be kept on record. The report filed on behalf of the State be also kept on record.
