The petitioner is aggrieved by inaction on the part of the Chairperson, Board of Administrator, North Dum Dum Municipality in not disposing of the application for mutation filed two years ago. It is submitted that of and on the municipal authorities have required the petitioner to file certain documents, which the petitioner has already filed. The petitioner submits that several representations have been made before the North Dum Dum Municipality and lastly on August 10, 2020 but the mutation certificate has not yet been issued in favour of the petitioner. Under such circumstances, this writ petition is disposed of with a direction upon the Board of Administrator, North Dum Dum Municipality to take a decision on the application for grant of mutation certificate made by the petitioner upon hearing the petitioner, all

interested parties and any other authority who deserve to be heard and are likely to be affected by a decision of the Board of Administrators.

The Board of Administrators shall take a decision and pass a reasoned order within a period of six weeks from date of communication of this order. The reasoned order should be communicated within a week thereafter to all the interested parties.

If it is found by the Board of Administrators that the petitioner is not eligible for grant of mutation certificate then reasons should be disclosed. If it is found that the petitioner is eligible for grant of mutation certificate then the said certificate should be issued within the time limit as provided hereinabove.

Accordingly, WPA 7348 of 2020 along with CAN 1 of 2020 are disposed of.

There will be, however, no order as to costs. Urgent Photostat certified copy of this order, if applied for, be given to the parties on priority basis. (Shampa Sarkar, J.)
