Learned advocate for the petitioners submits that the petitioners are in custody for a considerable period of time and in spite of dates being fixed the trial court could not proceed with the matter.

Mr. Saibal Bapuli, learned advocate for the State opposes the prayer for bail in view of the fact that commercial quantity of contraband was recovered in this case.

We have taken into account the facts of the case and in view of Section 37 of the NDPS Act, we are not inclined to release the petitioners on bail.

Accordingly, the prayer for bail is rejected.

However, in view of the fact that the petitioners are in custody for more than one year six months, the learned trial court is directed to expedite the process of trial once the normal functioning of the court resumes.

The application for bail being C.R.M. 6979 of 2020 and C.R.A.N. 1 of 2020 are disposed of.
