The petitioner undertake to affirm and stamp the petition as per Rules within a month of resumption of normal functioning of the court. The application is taken up through video conference on the basis of such undertaking.
The learned counsel for the petitioner has submitted that the petitioner has been falsely implicated in this case and has prayed for grant of anticipatory bail.
The learned counsel for the State has opposed such prayer and submits that the applicant along with others filed an application for anticipatory bail before a coordinate bench earlier and the same was dismissed on 23rd December, 2019 (being CRM 12059 of 2019). It appears that the coordinate bench upon consideration of the materials on record opined that it discloses prima facie involvement of the petitioner in torturing the victim housewife over dowry resulting in
her unnatural death within two years of marriage and, accordingly, declined to allow the prayer for anticipatory bail. The learned counsel for the petitioner however submits that he is not aware of the said order.
Since there has been no change in circumstances, we do not find any reason to revisit the issue. Accordingly, the prayer for anticipatory bail is rejected.
