1. We have the heard the learned Counsel for the petitioner. It appears that the Executive Engineer, Burdwan Investigation and Planning Division, Purta Bhaban, 3rd Floor, Burdwan, has communicated the direction of Joint Secretary to the Government of West Bengal, Irrigation & Waterways Department with regard to absence period of the petitioner. The said order has indicated the period of regularization consequent upon the direction passed by this Court upon the Joint Secretary to decide his application for regularization of the period of absence.

2. Since an order has already been passed the same gives a fresh cause of action to challenge such order in accordance with law. In this jurisdiction, we are unable to entertain the grievances raised by the petitioner with regard to the merits of the said order.

3. With the aforesaid observation, we dismiss the contempt application.
