CRM 7006 of 2020 (CRAN 1 of 2020) (Via Video Conference) In Re: - An application for anticipatory bail under Section 438 of the Code of Criminal Procedure in connection with Bongaon P.S. Case No.137 of 2020 dated 06.03.2020 under Sections 498A/304B/34 of the Indian Penal Code read with Sections 3 and 4 of the Dowry Prohibition Act.

The petitioner undertakes to affirm and stamp the petition as per the Rules within one week of resumption of normal functioning of the court. The petition is taken up through video conference on the basis of such undertaking.

The petitioner is the mother-in-law of the victim. The daughter-in-law committed suicide.

The post-mortem report does not reveal any external injuries and the hanging appears to be an act of suicide. In the circumstances, the petitioner need not be taken into custody at this stage. The petitioner will be entitled to anticipatory bail; but she must attend every date fixed for trial. In the event of any unexplained absence, the trial court will be entitled to cancel the bail without reference to this court.

In the event of arrest, the petitioner will be enlarged on bail on furnishing security of Rs.10,000/- (Rupees Ten Thousand only), with two sureties of like amount, one of whom must be local, to the satisfaction of the Arresting Officer. In addition, the petitioner will abide by the conditions in Section 438(2) of the Code of Criminal Procedure, 1973.
