The advocate-on-record for the petitioner undertakes to affirm and stamp the petition as per the Rules within one month of resumption of normal functioning of the court. The petition is taken up through video conference on the basis of such undertaking.

Having heard the learned Advocate for the petitioner and the learned Advocate for the State and on careful perusal of the application as well as the case diary, we are of the view that in a case where allegation has been made against the petitioner on the basis of last seen together with the victim, proper investigation cannot be conducted without custodial interrogation of the petitioner.

For the reasons stated above we are not inclined to release the petitioner on anticipatory bail.

Prayer for anticipatory bail is thus refused.
