Mr. Swapan Banerjee Ms. Purnima Ghosh ....for the State The Learned Advocate appearing for the Petitioner is aggrieved by the order dated 11th January, 2020 passed by the learned Special Judge, 2nd Court, Calcutta wherein his prayer for return of seized articles was refused by the learned Court. Mr. Mukherji, learned Public Prosecutor appearing for the State submits that the petitioner has enclosed his own documents to substantiate the authority for holding the money which were never before the learned special Court when the prayer for return was considered.

It has also been submitted by the State that the investigation of the case is still continuing. The petitioner will be at liberty to renew his prayer before the learned Special Court after the charge-sheet is submitted.

Needless to state that at the very inception, learned advocate for the petitioner has not pressed for hearing of the proceedings on the point of quashing.

With the aforesaid observation, CRR 1359 of 2020 is disposed of.

Pending application, if any, is consequently disposed of.
