Versus
The State of West Bengal Mr. A. Jana, Adv.
Mr. A. Mondal, Adv.
...for the Petitioner.
Mr. Madhusudan Sur, Adv.
Mr. Dipankar Paramanick, Adv.
...for the State.
The petitioner undertakes to affirm and stamp the petition/application as per the Rules within a month of resumption of normal functioning of the court. Subject to such undertaking, the application is taken up through video conference. CRAN 1 of 2020 is accordingly, disposed of.
Learned Counsel appearing for the petitioner fairly submitted that on 13th February, 2020 the application for bail was rejected. However, he renewed is prayer for bail in view of the fact that the trial did not progress due to unavailability of the judicial officer.
Learned Counsel for the State opposes the prayer for bail and submits that the charge-sheet has been filed and the charges have been framed. Considering the gravity of offence and the materials on record disclosing prima facie involvement of the petitioner in the alleged crime, we are of the opinion that this is not a fit case to grant bail to the petitioner at this stage. However, we direct the learned District Judge to assign this matter to a regular Bench so that the trial could be expedited.
The application for bail is, accordingly, rejected. (Saugata Bhattacharyya, J.) (Soumen Sen, J.)
