Case No.323 of 2019 dated December 3, 2019 under sections 406/420/409/120B of the Indian Penal Code (G. R. Case No. 3207 of 2019).

Mr. Swagata Datta ...for the petitioner. Mr. Ranabir Roy Chowdhury Mr. Mainak Gupta ... for the State. The complaint against the petitioner was in December, 2019 about alleged mis-appropriation of funds.

Learned advocate appearing for the State informs the court that since then the entire amount has been repaid by him. More importantly, the police has not taken the petitioner into custody.

In our opinion, this is a fit case to grant anticipatory bail to the petitioner. Accordingly, we allow the said application for anticipatory bail. In the event of arrest, the petitioner will be released on bail upon furnishing security of Rs.10,000/- (Rupees ten thousand only) together with personal release bond of equivalent value to the satisfaction of the arresting officer.

The petitioner shall also comply with the conditions laid down in section 438(2) of the Code of Criminal Procedure. CRM 7052 of 2020 is, thus, disposed of.
