An order of the Special Officer (Building) exercising jurisdiction under the provisions of the Kolkata Municipal Corporation Act, 1980 is under challenge in the present writ petition.

According to the petitioners, the impugned order was passed without hearing the petitioners. According to the

private respondents, the impugned order was passed after hearing of the parties.

Kolkata Municipal Corporation authorities are represented.

In the facts of the present case, since, there exist a statutory alternative remedy as against the impugned order, I am not minded to interfere under Article 226 of the Constitution of India.

W.P.A. No.7398 of 2020 is disposed of.
