Learned Senior advocate appearing on behalf of the petitioner submits that he has been falsely implicated in the instant case. Learned lawyer for the State opposes the prayer for bail. Having considered the materials on record and in view of the prima facie involvement of the petitioner and others in dealing in narcotic substance above commercial quantity and in the light of the statutory restrictions under Section 37 of the NDPS Act, we are not inclined to grant bail to the petitioner.

It is contended in view of the prevailing pandamic conditions prayer has been made to shift the petitioner from Hooghly correctional home to Serampore Sub-divisional correctional home. Concerned authorities may consider such application promptly and in accordance with law. The authorities shall also ensure appropriate medical attention to the petitioner, if necessary.

CRM 7074 of 2020 is disposed of.

The parties shall act in terms of the copy of the order downloaded from the official website of this Court.
