07 & 08 04.02.2021 KC C.P.A.N. 453 of 2020 in W.P.A. 19601 of 2019 (CAN 1 of 2020) Pratim Bhowmick & Anr.

Vs.

Sanjoy Ghosh & Ors.

Mr. M. Maity Ms. Manika Sarkar.

... for the petitioner.

Mr. Ashim Kumar Routh.

... for the respondents.

The petitioner complains of violation of the order dated November 7, 2019.

Such order was passed in a writ petition. The writ petition is still pending.

The petitioner complains that, despite the police being directed to ensure that no breach of peace occures at the locale, the private respondents are threatening the petitioner. The police are inactive on the complaints lodged with them.

The alleged contemnor no. 3 is represented.

In the facts of the present case, since the writ petition is yet to be finally decided, I am not minded to

enforce the interim order dated November 7, 2019. However, this order will not prevent the petitioner from taking appropriate steps with regard to the police complaint lodged subsequent to the order dated November 7, 2019, in accordance with law.

CPAN 453 of 2020 is disposed of accordingly without any order as to costs.
