The present writ petition has been preferred alleging inaction on the part of the Calcutta Electric Supply Corporation Limited (in short, "CESC") authorities to grant new electricity connection in favour of the petitioner. Mr. Das, learned advocate appearing for the petitioner submits that in response to the petitioner's application for new connection, a letter dated 14th September, 2020 was issued on behalf of the CESC authorities to the petitioner intimating that an inspection would be conducted on 16th September, 2020. However, no such inspection was carried out and the petitioner's application has been kept pending.
He submits that one Mr. Sandeep Bohra handed over the possession of the concerned flat to the petitioner. In respect of the said flat there is an existing electricity
meter in the name of Mr. Bohra. A representation was submitted by Mr. Bohra to the Senior Commercial Executive, CESC, for disconnection and removal of the said meter.
Mr. Das further submits that the meter of Mr. Bohra has not been removed and the petitioner is enjoying electricity through the said meter upon payment of the bills, as would be explicit from the documents annexed to the writ petition.
Mr. Das submits that new connection should be granted by the CESC authorities in favour of the petitioner simultaneously upon disconnection of the meter presently existing in the name of Mr. Bohra, so that the petitioner can enjoy electricity uninterruptedly.
Ms. Baisakhi Nag Chowdhury, Deputy Manager (Legal), CESC Limited, appears in person and submits, upon instruction, that the CESC authorities are agreeable to offer a new meter in favour of the petitioner subject to disconnection of a meter bearing no. 3666755 and a meter bearing no.5053250. Let the written instruction, as produced, be kept on record.
The meter bearing no.3666755 is not involved in the present lis and as such the petitioner's connection cannot be withheld for non-removal of the said mater bearing no.3666755.
As Mr. Bohra has already applied for disconnection of the meter no.5053250 standing in his name, there can
be no hindrance towards removal of the same and installation of a new meter in the name of present petitioner simultaneously ensuring continuous electricity supply to the petitioner.
This Court directs the respondents to install a new meter in the name of the petitioner and to grant new electricity connection, subject to compliance of all necessary formalities, if any, within a period of two weeks from the date of communication of this order. With the above observations and directions, the writ petition is disposed of.
All concerned parties shall act in terms of the copy of the order downloaded from the official website of this Court.
