The petitioners pray for compassionate appointment under the died-in-harness category. The father of the petitioner no. 2 was an employee of the Durgapur Municipal Corporation. He died-in-harness on November 1, 2014.

An application for being appointed on compassionate ground was filed on November 21, 2014. The petitioners complain that time and again representations have been made before the municipality praying for consideration of the application for compassionate appointment to the son but the

respondents have not taken any steps to consider the same till date.

The learned advocate representing the Durgapur Municipal Corporation is not aware as to why the application of the petitioners has not been taken up for consideration for such a long period of time. Be that as it may, as it appears that the application for compassionate appointment is pending consideration at the end of the municipal corporation, no useful purpose will be served by keeping the writ petition pending.

The writ petition is accordingly disposed of by directing the respondent authority to consider the prayer of the petitioner no. 2 for being appointed on compassionate ground, strictly in accordance with law, within a period of eight weeks from the date of communication of a copy of this order.

The respondent authority shall pass a reasoned order in the matter and communicate the same to the petitioners immediately thereafter.

WPA 7457 of 2020 and IA No. CAN/1/2020 are disposed of.

Urgent photostat certified copy of this order, if applied for, be given to the parties after completion of all legal formalities.
