Mr. S.G. Mukherji, Ld. PP Mr. Aniket Mitra ....for the State The petitioner was successfully absconding and evading arrest. The learned Special Judge, Murshidabad concluded hearing of the case as against another accused when he found that the petitioner could not be apprehended even after issuance proclamation of arrest and attachment of his properties. The case against the co-accused ended in acquittal. Only then the petitioner has filed the instant application for anticipatory bail.

We are of the view that the conduct of the petitioner is not at all satisfactory.

He was hiding till the disposal of the NDPS case against a co-accused and then he came out and filed the instant application. The conduct of the petitioner being utterly unsatisfactory, we are not inclined to grant anticipatory bail. The learned Special Judge, NDPS, Murshidabad is directed to execute proclamation and attachment against the petitioner in accordance with law within two weeks after vacation.

Let a copy of this order be sent to the learned Special Judge, NDPS, Murshidabad by the learned Registrar General, High Court.
