Mr. S. S. Ray, learned advocate for the petitioner submits that the petitioner has approached the de facto complainant with a proposal and the de facto complainant received some money from the accused, which was alleged in the FIR.

Mr. Bapuli, learned advocate appearing for the State submits report which shows that investigation is in progress. The report shows that some money was handed over to the complainant towards part payment. The allegations are under Section 420/ 406/ 467/ 468/ 471/ 120B IPC.

Having regard to the manner in which the present complainant and other persons have been deprived by alluring them with fake stories and subsequently compelling them for parting with their property by alluring representations, I am of the view that offence complained has injured the society as a whole. Accordingly, even after the money being repaid, I am of the opinion that the act of the accused do not exonerate them from the offences

which they have committed. As such, the prayers so advanced before this court is refused.

Accordingly, CRR 1369 of 2020 is dismissed.

Interim order, if any, is hereby vacated.

Pending connected applications being CRAN 2 of 2020 is dismissed In view of the investigation still continuing it is directed that within a reasonable period of time the Investigating Agency should file its report under Section 173 before the Jurisdictional Court.
