Mehebub Alam @ Mahebub v. State Of West Bengal
01.10.2020 Supp.02 Ct. No. 19 NB/AGM Reject CRM 7158 of 2020 CRAN 1 of 2020 (Via Video Conference) In Re : An application for bail under Section 439 of the Code of Criminal Procedure.
And In the matter of : Mehebub Alam @ Mahebub ..... Petitioner Mr. Sagar Saha.
... for the petitioner Mr. Ranabir Roy Chowdhury, Mr. Mainak Gupta. ...for the State. Learned Counsel appearing on behalf of the petitioner submits as follows. The petitioner is in custody for more that one year. The petitioner is not the prime accused in this case. The only purported connection he has in the present allegation is that the petitioner had gone to the ATM concerned to check his balance and out of some mistake, he was also arraigned as an accused. Learned Counsel appearing on behalf of the State opposes the prayer for bail. He submits that the petitioner's prayer for bail was lastly rejected by this Court on 05.06.2020. During trial a number of witnesses were examined and only three are left to be examined. The petitioner was identified in the T.I. Parade by the complainant. Considering the materials available against the petitioner, the fact that the petitioner's prayer was rejected by this Court lastly on 05.06.2020 and in view of the mature stage of the trial, I am not inclined to grant bail to the petitioner.
Accordingly, the application for bail is rejected. CRM No.7158 of 2020 along with CRAN 1 of 2020 are disposed of.
Urgent photostat certified copy of this order may be supplied to the parties expeditiously, if applied for.
