SG CRM 7160 of 2020 with CRAN 1 of 2020 In Re. An application for bail under Section 438 of the Code of Criminal Procedure in connection with Berhampore Police Station Case No.125 of 2020 dated 06.02.2020 under Sections 341/324/325/ 326/307/302/34 of the Indian Penal Code.

The petitioners undertake to affirm and stamp the petition as per the Rules within 48 hours of resumption of normal functioning of the court. The petition is taken up through video conference on the basis of such undertaking. The petitioners say that the incident between the groups led to a death of one Kasem Sk.

The State produces the records wherefrom it appears that there are the statements of the eyewitnesses recorded under Section 161 of the Code. From such statements it further appears that the petitioners are named as the assailants who caused several persons to be injured. Kasem Sk died at the Berhampore Hospital. There are several statements made by several eyewitnesses which are also on record corroborating such position.

Considering the material on record, the petitioners are not entitled to anticipatory bail.
