The petition is taken up through video conference on the basis of such undertaking.
This is another case where the petitioner has been proceeded against merely on the statement of an accused in an NDPS case. No recovery of any contraband was made from the petitioner.
The case records produced do not reveal any independent material against the petitioner other than the uncorroborated statement of a person arrested with drugs in his possession. The petitioner is entitled to bail. The petitioner will be enlarged on bail upon furnishing security of Rs.10,000/-, with two sureties of like amount, one of whom must be local, to the satisfaction of the appropriate Court in North 24 Parganas. The petitioner will also attend every date fixed for trial and any unexplained
absence will entitle the trial Court to cancel the bail without reference to this Court.
CRM 7165 of 2020 along with interim application therein are disposed of.
