19.10.2020 Item No.11 Ct. No.24 CHC W.P.A.7514 of 2020 C.A.N.1 of 2020 (Via Video Conference) r Doli Mukhopadhyay @ Doly Mukhopadhyay Vs.

The State of West Bengal & ors.

Mr. Debajyoti Deb, Mr. Pabitra Biswas ...for the petitioner Mrs. Chama Mookherji, Sr. Govt. Advocate Ms. Manika Pandit ...for the State respondent C.A.N.1 of 2020 is application for urgent consideration of the writ petition. The application is disposed of by taking up the writ petition for consideration.

Petitioner complains of police inaction.

Learned advocate appearing for the petitioner submits that the petitioner was removed from her home without due process of law. The police are inactive.

Learned advocate appearing for the State submits on written instruction that, the complaint of the petitioner was treated as First Information Report and that, the investigation with regard thereto is in progress.

It appears from the records that, the petitioner claims to be an allottee of land from a cooperative society. Apparently, there are disputes with regard to the allotment. According to the society, since the petitioner did not respond to advertisement the property was allotted to another person. The version of the petitioner is different.

There are, therefore, disputes with regard to the immovable property which a writ court need not enter into. So far as police complaint is concerned, police have registered the same as a First Information Report and the investigation with regard thereto is under progress. The police having taken steps as noted above, no further interference is called for. This, however, will not prevent the private parties from availing of their remedies before appropriate forum, in accordance with law.

W.P.A.7514 of 2020 is disposed of.
